1. Acceptance of Terms

Welcome to HOTxAI Creative (hereinafter referred to as the "Platform"). This Platform provides artificial intelligence (AI)-based image and video generation services, supporting custom text prompts or tagged inputs to allow users to create high-quality static images and short videos. By accessing or using the Platform's services, you represent that you have fully read, understood, and agree to comply with these "Terms of Service". If you do not agree to any part of these terms, please immediately discontinue the use of the Platform's services.

2. Age Verification Policy

The Platform is suitable for users aged 13 and older. If you are under the age of 13, please do not use this service. If you are a minor between the ages of 13 and 18, you must obtain the consent of your parent or legal guardian and use the service under their supervision. We reserve the right to request additional age verification. If a violation of the age restriction is discovered, the account will be frozen, and the associated content will be deleted.

3. User Conduct and Prohibited Content

You agree that when using this service, you will not generate, upload, or share the following content:

• Illegal Content: Content promoting terrorism, drug trafficking, illegal activities, or other criminal acts.
• Hate Speech or Discriminatory Content: Offensive content based on race, religion, gender, sexual orientation, or disability.
• Violence or Harmful Content: Extremely realistic violence, gore, self-harm, or abusive content.
• Infringing Content: Unauthorized portraits of real individuals, trademarks, or copyright-infringing content.
• Service Abuse: Mass automated generation, distributing spam, reverse-engineering the platform, or interfering with others' use.

4. AI-Generated Content Marking and Watermark Policy

All generation results automatically embed an invisible watermark and C2PA metadata, marked "AI Generated by HOTxAI Creative". Users must not remove or attempt to remove or tamper with this mark.

5. Data Storage and Retention Period

The Platform provides generation services rather than permanent cloud storage. Generated content is stored temporarily, and we strongly recommend downloading and backing up your creations immediately. Old files will be automatically cleared according to a published schedule (e.g., 30-60 days). The Platform assumes no liability for any loss of files due to server failure, maintenance, or automated clearing mechanisms.

6. Credits, Payments, and Refund Policy

• Virtual Goods: Credits are virtual goods, strictly limited to use within the Platform, and cannot be transferred, resold, or exchanged for cash.
• Consumption Calculation: Credit consumption is calculated based on model costs, resolution, and video length. The actual deduction is subject to the system display at the time of generation.
• Refund Policy: Except as required by law, all credit purchases are strictly non-refundable. If an account is suspended for violating the Terms of Service, any remaining credits will automatically be invalidated.
• Account Deletion: You may delete your account at any time, but purchased credits will not be refunded.

7. Intellectual Property Rights

• Your Rights: Subject to compliance with these terms and applicable laws, you retain ownership of the content you generate through the Platform, which may be used for personal or commercial purposes (subject to the specific license of the AI model).
• Platform License: To provide the service (such as displaying generation history, improving models, generating thumbnails), you grant the Platform a worldwide, royalty-free license to use, host, and store your generated content.
• Infringement Liability: You must ensure that your input prompts and uploaded images do not infringe upon the rights of others. If disputes arise, you bear sole legal responsibility and must indemnify the Platform against any resulting losses.
• Model Training Transparency: The Platform's models are trained using legally licensed or synthetic data. We strictly do not use personal data for training without explicit consent.

8. User-Generated Content (UGC) Liability & Reporting Mechanism

The Platform acts solely as a technical service provider. All generated content is produced based on the user's input, and the user bears full legal responsibility for it. The Platform has no prior review obligation, but if we discover or receive reports of violating content, we will remove it, freeze the account, and may provide relevant data to law enforcement agencies.

If you believe any content infringes upon your copyright, please submit a DMCA takedown notice (including your signature, infringing URLs, and contact information). We will review and process it within a reasonable time upon receipt.

9. Disclaimer and Limitation of Liability

The service is provided on an "as-is" basis, without express or implied warranties of any kind. We do not guarantee that the generated content will be accurate, error-free, or meet your expectations; AI may produce illogical results. We do not guarantee that the service will be continuous, secure, or free of errors. To the maximum extent permitted by applicable law, the Platform shall not be liable for any indirect, incidental, special, or punitive damages.

10. Cookie and Local Storage Policy

This website utilizes necessary Cookies and local storage technologies to maintain login status, language preferences, and task progress. For details, please refer to our Privacy Policy.

11. Governing Law and Dispute Resolution

These terms are governed by applicable international laws. In the event of a dispute, it shall be resolved in accordance with the applicable laws and regulations.

12. Modification of Terms

The Platform reserves the right to modify these Terms of Service at any time. The updated terms will be published on this page and take effect immediately upon posting. By continuing to use the service, you are deemed to have accepted the revised terms.
